Ground of Impotency should not be taken in a Khula Case

Even if the man is impotent and wife wants to take khula from him, this ground should not be taken in the case. The reason is that if the wife takes this ground as a ground of Khula, the Family Judge has powers to grant time to the husband to prove that he is not impotent. A husband can be given time of 1 year to prove that he is not impotent. In such like circumstances the case lingers on for no just reasons. So it is always advisable not to take the ground of impotency in the case. The best way to obtain khula decree in shortest possible times is to take the ground of hatred because the hateful union cannot continue as per the dictums laid down by the superior courts of Pakistan. Islamabad District Courts

District Court is the highest court in a district as per the provisions of Civil Procedure Code 1908. Similar for criminal justice systems the Sessions Court has the same stature. In Islamabad like most districts, the District Judges have the powers of Sessions Judges also. Islamabad was divided into two districts few years ago i.e. Islamabad East and Islamabad West. For that reason Islamabad has two District and Sessions Judges. Similarly each District and Sessions Judge has around 5 Additional District and Sessions Judges working under them. There are further 2 senior civil judges, along with several Family Judges, Civil Judges, Magistrates and Rent Controllers working under them. A family case shall be decided within 180 days

According to section 12-A of the West Pakistan Family Courts Act 1964, the family judge shall decide a family case within 6 months. Generally, majority of the family cases are decided within this stipulated time. However, few cases are not dealt in the manner prescribed by law because of many reasons. In case if litigation in a family suit takes more than 180 days time, the litigant should approach the High Court immediately without wasting any time. In routine matters, High Court easily give direction for disposal of family suits within a month or two in cases where the litigation runs more than 6 months.
