Prescription as to Sunni


1.       Presumption every Muslim is Sunni unless proved otherwise. 1999 YLR 2692, 2008 YLR 589.
2.       Deceased survived by widow or daughters. When ladies alleged deceased to Shia and not Sunni, onus lies on them to prove. Evidence of Pesh Iman who not conducted funeral prayers and not of the village where the deceased lived, disbelieved and inheritance distributed in accordance with Sunni law as presumption is in favour of being Sunni. 2001 CLC 229.

3.       Presumption of every Muslim Sunni. NLR 1998 AC 273.
